Design Infringement Case Decided

Copyright infringement is serious business. In the tattoo world, design infringement can mean that an honest artist loses a substantial amount of money when a dishonest one steals and markets work that doesn't belong to them.

It was heartening to see that the 4th District U.S. Circuit Court of Appeals agrees and ruled in favor of the tattoo artist who was getting ripped-off in this case.

Joe DuFresne, known professionally as J.D. Crowe, spent the better part of a year fighting to launch tattoo parlors in Virginia Beach and Chesapeake before opening in the cities about a decade ago.

DeFresne recently won an even longer legal battle. A federal appeals court last week upheld a $500,000 copyright infringement award, ending a court battle that dragged on more than three years.

With fees and interest to date, the total award tops $683,000.

DuFresne bills his company, Tattoo Art Inc., as creators of "the world's most popular tattoo designs." So popular that a Grand Rapids, Mich., company, TAT International, and its tattoo parlor, TatStore, bought a license to market Tattoo Art's designs.

Tattoo Art sued TAT for copyright infringement and breach of a licensing agreement after finding that TAT had altered some of its designs and were marketing them as its own, according to the court filings. (TAT had agreed to pay additional royalties but never did.)

U.S. District Judge Mark S. Davis in Norfolk held a non-jury trial in March 2011 and found against TAT. TAT appealed, arguing that the damage award was "grossly disproportionate" to the actual damages and "constitutionally excessive." The Richmond-based 4th U.S. Circuit Court of Appeals disagreed and upheld Davis' ruling last week.

What Every Tattoo Artist Wishes You Knew

Thinking About a Tattoo?

Before you go to any tattoo shop, there are a few things that you should consider to make the experience enjoyable for you, the other patrons, and the artist. All artists will want to hear your opinion, and want you to express your ideas, but some folks can get carried away. Tattoo artists are all highly trained in their field, and usually very passionate about their art. Like most artists, they tend to bruise easily, so tread lightly with your criticism, and Be Nice. That being said, here are a few things that they would like you to know (and remember) before you step into their shop.

Do not show up drunk for your tattoo. 

 Aside from the obvious health and sanitation issues, it's obnoxious. If you're not sober, most studios won't even let you get the tattoo. The Board of Health is rather particular about that, and no artist wants to work on a drunk.

Have some idea of what you want done. 

You don't need to show up with a drawing, in fact most artists won't use someone else's work, but you do have to have some idea of the kind of tattoo you want, including size and placement. Tattoo artists are experts at this and are used to looking at tattoos on the human body, so if an artist gives you a tip that a certain piece won't look good where you want it, or that the size is off, trust them and take their advice. Your input is valuable too however, so don't ever let an artist bully you into something you don't want. You will be living with it for the rest of your life (unless you want some laser tattoo removal  next).

Don't be cheap. 

When you're shopping around for an artist, price should be the last thing on your mind. Just as you wouldn't go to a backwoods, bargain-basement for a medical procedure, you need to remember that a tattoo is a sterile procedure done by a professional in a sterile environment (a good tattoo is at least). If you're looking for a bargain in this area, keep in mind that you'll get what you pay for.

The mark of a great tattoo studio is best seen in the overall satisfaction of the clients they serve. There are however, a few things that you do need to consider before allowing another person to take a needle to your skin.

Licensed Shop and Artists

This may seem like a no-brainer, but you would be amazed at the number of people who end up in emergency rooms every year with life threatening infections from underground tattoo artists, or backyard tattoo parties.
